Terms & Conditions
These Terms govern your relationship with the operator of betus-ca.com ("betus-casino") and apply to your access to and use of our gaming services. Effective date: 15 January 2025.
Definitions
Observe: We use the terms below consistently to avoid ambiguity.
- Operator: The entity operating betus-ca.com and providing the Services (identity and registered address provided on request; principal operations currently in San Jose, Costa Rica).
- Website/Site: betus-ca.com and any mobile or app interfaces controlled by the Operator.
- Services: Real-money and free-to-play casino games and related features, including live dealer and chat.
- Account: A registered user profile enabling access to Services.
- User/Player/You: The natural person who creates and uses an Account.
- Bet/Wager: Any stake you place on a game or event using Account funds or bonus funds.
- Bonus/Promotion: Value granted by the Operator subject to specific terms (including wagering requirements).
- Wagering Requirements (WR): The multiple of bonus (or bonus plus deposit) that must be bet before withdrawal.
- RNG: Random Number Generator used to produce fair, unpredictable outcomes.
- Payment Method: A deposit/withdrawal instrument (cards, e-wallets, bank transfer, crypto).
- Chargeback: A reversal of a card or payment transaction initiated by you or your provider.
- Restricted Jurisdiction: Any place where use of the Services is illegal or prohibited by the Operator (which includes Ontario, Canada).
- CAD: Canadian dollars (account and settlement currency unless otherwise stated).
Reflect: These definitions govern interpretation throughout these Terms.
Account Registration
Observe: Account creation requires: (a) personal details, (b) email verification, (c) acceptance of these Terms, and (d) one Account per person, household, IP, or device cluster.
- Eligibility & Age: You must be of legal gambling age in your province/territory and at least 18 years old. In Canada this generally means 19+ (18+ in AB/MB/QC). Access is prohibited where illegal or restricted.
- Prohibited Locations: You must not access or use the Services from Restricted Jurisdictions, including Ontario, Canada, or where local law forbids online gambling.
- KYC/Verification: We may request government ID, proof of address, payment method proof, source-of-funds/source-of-wealth, and conduct PEP/sanctions screening. Unverified users may be suspended; withdrawals require completed KYC.
- Data Accuracy & Security: Provide accurate, current information and keep credentials confidential. You are responsible for activity under your Account until you notify support of suspected compromise.
- One Account Policy: Multiple accounts or identity misrepresentation may lead to closure and forfeiture of bonuses and winnings derived from breach.
Expand: We apply AML/CTF controls, affordability and fraud checks. Geolocation and device fingerprinting may be used to detect restricted access. If you relocate to a Restricted Jurisdiction, you must stop using the Services.
Reflect: Failure to meet eligibility, complete KYC, or comply with access restrictions may result in suspension or termination under these Terms.
Betting & Gameplay Rules
Observe: Bets are accepted per game rules and available limits displayed on-screen at the time of placement.
- Bet Placement: Minimum/maximum stakes and bet types are presented in-game. A bet is valid only after our systems confirm acceptance and deduct funds.
- Settlement: Casino outcomes are determined by certified RNG or, for live dealer, by the live game result. In case of discrepancy, the server record prevails.
- Cancellations/Voids: We may void or correct bets for palpable error, malfunction (as defined by game supplier rules), mispriced markets, or regulatory breach. Your remedy is re-crediting the stake.
- Disconnections/Latency: Completed server outcomes stand. If a round is unfinished due to disconnection, it may auto-complete on the server; you can view results via game history.
- Conduct: No collusion, advantage play, bot use, chip-dumping, or exploitation of bugs. Live chat must be respectful; no harassment, hate speech, spam, or solicitation.
- Responsible Play: You should wager only what you can afford to lose. Tools for limits and time-outs may be available; contact support for assistance.
Expand: We reserve the right to suspend games for maintenance or security. Progressive jackpots are paid per provider rules and may be subject to verification and payment schedules.
Reflect: Non-compliant play may lead to bet cancellation, confiscation of illicit gains, and account action.
Bonus Terms
Observe: Each promotion includes specific terms on eligibility, activation, WR, game weighting, time limits, and maximum bet.
- Activation: Bonuses may require an opt-in, code, or minimum deposit. Only one promotion can usually be active at a time unless expressly allowed.
- Wagering: Unless stated otherwise, standard WR is 30x-60x bonus (or bonus+deposit for match offers). WR must be completed within the stated timeframe (commonly 7-30 days).
- Game Weighting: Slots typically 100%; table games/video poker/live dealer commonly 0-10%; excluded games do not contribute.
- Max Bet & Caps: While wagering a bonus, the maximum single bet is typically CAD 5 or 10% of bonus amount (whichever is lower) unless stated otherwise. Winnings from free spins may be capped per offer.
- Prohibited Actions: Low-risk/zero-risk bets, equal/near-equal betting, hedge betting, multi-accounting, or delaying bonus rounds are prohibited and may void the bonus and related winnings.
- Combining Promotions: Promotions cannot be combined unless expressly permitted. In conflicts, the specific promo terms prevail.
- Expiry & Forfeiture: Unused bonuses expire at the stated time; on expiry or withdrawal request before WR completion, remaining bonus funds are forfeited.
Expand: We may audit gameplay for bonus abuse. If we detect abuse, we may remove bonuses, void winnings from abuse, and apply account sanctions.
Reflect: Always review individual promotional pages; participation indicates acceptance of those specific terms in addition to these Terms.
Payments & Withdrawals
Observe: Supported methods may include cards, e-wallets, bank transfers, and cryptocurrencies (availability varies by region and verification status).
- Deposits: Deposits are generally credited instantly. Minimum and maximum limits are displayed in the cashier. Fees, if any, are shown at transaction time; your bank/wallet/crypto network may charge additional fees.
- Withdrawals: Subject to completed KYC and security checks. Typical processing: e-wallets/crypto 0-24h; cards/bank 1-5 business days after approval. We may request the original deposit method for payout where feasible.
- Currency & FX: Accounts operate in CAD where offered. If a transaction occurs in another currency, your provider's exchange rate and fees apply.
- Crypto: Network fees and price volatility are outside our control. Payouts are based on the crypto amount confirmed at the time of processing per cashier terms.
- Anti-Fraud: We may hold or reverse transactions pending investigation of chargebacks, fraud, AML flags, or bonus abuse. Source-of-funds may be required for large transactions or wins.
- Refunds/Adjustments: Erroneous credits may be reversed. If a game malfunctions, bets may be voided and stakes returned. Bonus funds are non-refundable.
Expand: We may set daily/weekly/monthly withdrawal limits and request method ownership proof. In case of conflicting payment method rules, regulatory or provider rules prevail.
Reflect: Use your own payment instruments. Keep records; contact support for any transaction discrepancies within 30 days.
Limitation of Liability
Observe: We provide Services using reasonable skill and care and will settle results per the applicable game/provider rules.
- No Warranty: Services are provided "as is" and "as available." We do not warrant uninterrupted, error-free operation or compatibility with your devices/network.
- Exclusions: We are not liable for network failures, disconnections, latency, third-party service outages, force majeure, or errors caused by you or your equipment.
- Cap on Liability: To the maximum extent permitted by law, our total liability for any bet/game is limited to refunding the stake of the affected bet or the amount in dispute, whichever is lower.
- Non-Excludable: Nothing excludes liability for fraud, fraudulent misrepresentation, or other liability that cannot be excluded under applicable law.
Expand: Indirect, consequential, or special damages (including loss of profits, data, or business) are disclaimed to the extent permitted by law.
Reflect: Your sole remedy for a disputed outcome is stake refund or correction per these Terms.
Intellectual Property Rights
Observe: All content, software, trademarks, and materials on betus-ca.com are owned by or licensed to the Operator and protected by IP laws.
- License: We grant you a limited, revocable, non-transferable, non-sublicensable license to access and use the Services for personal, non-commercial entertainment.
- Restrictions: No copying, modifying, reverse engineering, distributing, framing, scraping, data mining, or derivative works without prior written consent.
- Third-Party IP: Game provider marks and content remain the property of their respective owners.
Reflect: Unauthorized use terminates your license and may result in legal action.
Privacy & Data Protection
Observe: Your personal data is processed according to our Privacy Policy available on betus-ca.com.
- Scope: Data may be processed outside Canada (including Costa Rica and other jurisdictions) for KYC, AML, fraud prevention, payments, analytics, and customer support.
- Rights: You may have rights of access, rectification, deletion, and objection subject to applicable laws and our legitimate interests/compliance obligations.
Reflect: By using the Services, you acknowledge the Privacy Policy and cross-border transfers described therein.
Changes to Terms
Observe: We may update these Terms to reflect legal, technical, or business changes.
- Notice: Material changes will be communicated via email (where available) and/or on-site banner/notification at least 7 days before the effective date unless law or security requires shorter notice.
- Your Options: If you disagree, stop using the Services and request Account closure before the effective date; continued use after the effective date constitutes acceptance.
- Versioning: We maintain an archive or change log upon request.
Reflect: Review Terms periodically; your continued use confirms agreement.
Termination & Suspension
Observe: We may suspend or close Accounts for legal, security, or policy reasons; you may close your Account at any time.
- Grounds: Breach of these Terms, fraud/AML concerns, bonus abuse, chargebacks, duplicate accounts, restricted access, or regulatory request.
- Process: We will notify you via email where lawful and feasible, stating reasons and effective date. We may freeze funds during investigations.
- Funds: On closure (other than for fraud/illegal activity), we will return available real-money balances via a method reasonably available, subject to KYC and withdrawal rules. Bonuses and related winnings may be forfeited per the relevant terms.
- Self-Exclusion: Where offered, you may request exclusion; we will block access for the selected period.
Reflect: You remain responsible for activity prior to closure and for cooperating with verification and withdrawal steps.
Governing Law & Jurisdiction
Observe: These Terms are governed by the laws of Costa Rica, excluding its conflict-of-laws rules.
- Arbitration: Except where prohibited by provincial consumer protection law, disputes shall be finally resolved by confidential, binding arbitration under the ICC Rules by a sole arbitrator, seat San José, Costa Rica, language English.
- Consumer Rights (Canada): If your provincial/territorial law prohibits mandatory arbitration or class-action waiver, you may bring your claim in the courts of your province/territory, and the arbitration clause does not apply to you.
- Class Actions: To the extent permitted by law, disputes are resolved on an individual basis; class/representative actions are waived.
- Limitation Period: To the extent permitted, any claim must be filed within two (2) years from the event giving rise to the claim.
Reflect: This section allocates forum and process while preserving non-waivable Canadian consumer rights.
